By accessing or using the Site or our services, you agree to be bound by these Terms and all additional rules, policies, or guidelines incorporated herein by reference. If you do not agree to these Terms, please do not use the Site or our services.
1. Applicability & Acceptance
You represent and warrant that you are at least 18 years old (or have legal capacity in your jurisdiction) and have the right to enter into these Terms. Your use of the Site constitutes your acceptance of these Terms. We may modify these Terms at any time by posting revised terms on the Site. Your continued use of the Site after modifications means you accept the updated terms.
2. Additional Terms
Certain parts of the Site and services (for example, tours registration, employment applications, or resident inquiry submissions) may be subject to additional terms (“Additional Terms”). Those Additional Terms are incorporated into these Terms. In case of conflict, the Additional Terms shall govern.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HUMMINGBIRD SENIOR LIVING LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR BUSINESS, ARISING FROM YOUR USE OR INABILITY TO USE THE SITE, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED [ “THE AMOUNT YOU PAID US (IF ANY)”].
8. Indemnification
You agree to defend, indemnify and hold harmless Hummingbird Senior Living LLC, its officers, directors, employees, agents and affiliates from and against any claims, damages, losses, liabilities, costs or expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms, your use of the Site, your content, or your violation of any rights of a third party.
9. Termination
We may suspend or terminate your access to all or part of the Site, without notice and for any reason, including if we believe you have violated these Terms. On termination, your rights under these Terms will immediately cease, but your obligations survive.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. You submit to the exclusive jurisdiction and venue of the state and federal courts located in Sierra Vista, Arizona.
11. Privacy & Electronic Communications
Your use of the Site is subject to our Privacy Policy, which is incorporated herein by reference. By using the Site, you consent to receive electronic communications from us. Those communications may include notices about your account, the Site and promotional messages. You may opt-out of receiving promotional emails, following the instructions in each email.
12. SMS Terms of Service
By opting in to receive SMS messages from Hummingbird Senior Resort Living LLC, you agree to receive text messages related to inquiries, tour confirmations, appointment reminders, follow-ups, and occasional marketing communications.
You can cancel the SMS service at any time by texting “STOP” to (520) 523-5246. After you send the SMS message “STOP” to us, we will send you a confirmation message indicating that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, you may sign up through the same opt-in process as you did initially, and we will resume sending SMS messages to you.

Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary but typically does not exceed 3–4 messages per month, depending on inquiry and appointment activity. If you have any questions about your text or data plan, it is best to contact your wireless provider.

15. Export Control & Local Laws
